Every item sold on Evarpex must be authentic. This policy explains what authenticity means on our platform, the penalties for counterfeit activity, and the steps we take to protect brands, customers, and compliant sellers.
Authenticity Is Non-Negotiable
Evarpex is committed to a marketplace where customers only receive genuine goods. Selling fake, cloned, tampered, or pirated products is strictly prohibited. Vendors and suppliers must verify the origin of every item before listing it. By onboarding to Evarpex, you confirm that you can provide proof of authenticity on request.
What Counts as Counterfeit on Evarpex
- Products that imitate or reproduce a brand’s name, logo, colour scheme, or trademarked pattern without written consent.
- Bootleg or pirated versions of software, media, electronics, or accessories.
- Items labelled as “replica”, “first copy”, “mirror quality”, or similar language implying imitation.
- Original packaging that has been altered to hide prior use or to pass a product off as new.
If you are unsure whether a product might infringe on intellectual property rights, do not list it. Contact the brand owner or the Evarpex Compliance Desk before proceeding.
How Evarpex Enforces Brand Protection
- We conduct proactive scans, mystery purchases, and partner with rights holders to detect counterfeits.
- Listings suspected to infringe IP rights are immediately removed while we investigate.
- We cooperate with manufacturers, regulators, and law enforcement agencies across Africa.
- Repeat or severe offenders may be reported for civil or criminal action.
Consequences for Violating This Policy
Depending on severity and history, Evarpex may enforce the following actions:
- Immediate removal of suspected listings and suspension of product creation privileges.
- Return or destruction of inventory held in Evarpex-operated hubs without reimbursement.
- Temporary or permanent suspension of payouts and store access.
- Termination of the seller agreement and escalation to regulators or brand owners.
Penalty Matrix for Counterfeit Listings
- First breach: Listing removed. Submit authorised supplier documentation within seven (7) business days or incur a ₦50,000 compliance penalty.
- Second breach: Listing removed, ₦50,000 penalty applied, and the store is permanently delisted if proof is not provided within seven (7) business days.
These rules apply to all sellers on Evarpex, whether new or established. Persistent counterfeit activity can also lead to legal proceedings under Nigerian law.
If You Receive a Counterfeit Alert
- Immediately delist the flagged product and any related variations.
- Gather invoices, distribution agreements, or letters of authorisation that confirm authenticity.
- Submit your documents through the Compliance Centre within seven (7) business days.
- If you believe the alert is incorrect, raise a Compliance Ticket from your seller dashboard for re-evaluation.
Failure to respond within the stated timeline will result in the penalties outlined above.
